Florida has very strict license suspension laws when it comes to driving under the influence (DUI). Depending on whether this is your first DUI or you are facing multiple DUI charges, your driver’s license could be suspended from 180 days to permanent lifetime suspension. Suspension does not always mean that you cannot drive until your license is reinstated, however, because there are some cases in which you may be eligible to receive a hardship license.

Hardship Licenses

Hardship licenses are issued by the Florida Department of Highway Safety and Motor Vehicles (DHSMV) to individuals whose licenses have been suspended but who still need to drive to vital locations such as work and school. Anyone arrested for DUI will have their license suspended, but the firm can request a DMV hearing or waiver within 10 days of their arrest in the following cases:

  • Second DUI offense
  • Third DUI offense
  • Fourth or subsequent DUI

What to Expect in a DHSMV Hearing

If you are eligible to request a hardship license, make sure you know what to expect. DMV hearings are different than court hearings in that your case will be heard by an administrative hearing officer. The firm will appear at your scheduled hearing and present your argument as to how your license suspension will result in undue hardship. If the judge decides that you need a hardship license, you will be issued one that allows you to drive yourself to and from work. Some such licenses may also grant you to drive to school if you are a student.
